We do not represent that Our Application or Service is governed by or operated in accordance with the laws of all nations, or that Our Application or any portion of it is appropriate or available for Use in any particular location. If You choose to access Our Application or Use Our Services, You do so at Your own risk, and You are responsible for complying with all applicable laws, rules, and regulations in Your nation or territory.   

 

The Terms set out the formal terms and conditions for Using and playing the games available through the Application or Services and constitute a binding agreement between You and Us. These Terms govern Your access and Use of the Application and Services.

 

**Please read these Terms carefully before You decide whether to accept them.  If You do not agree to these Terms, You may not access, browse, or Use the Application or Services, and should discontinue Your activities immediately. If You access Our Application, You are agreeing to these Terms.**

 

## 1. ACCEPTANCE OF TERMS AND CONDITIONS

 

**1.1 Terms acceptance -** By accepting, accessing, and/or using the Services, You acknowledge and affirmatively signify that:

 

- You have read and understood these Prize Terms, the Privacy Policy, and the Terms and Conditions, controls, and guidelines which can be found within the Application, all of which are incorporated herein by reference;

- You have evaluated the laws, regulations, and directives relating to Your Use of the Application or Services, and your use or access to the Application or Services will not violate any applicable law, regulation, or directive;

- You are an individual and to be eligible for Prizes You are eighteen (18) years of age and/or over the legal age of majority under applicable law in the jurisdiction in which You reside;

- If you are under the age of legal majority, you understand a parent or guardian must accept and receive prizes on your behalf.

- You are authorized and able to accept these Terms;

  • You are physically located in an Eligible Jurisdiction to receive Cash Prizes and are unrestricted by that jurisdiction’s laws;

  • You understand the start date and end date;

  • You understand winning a Tournament means taking the least amount of time to land on all three WIN PLATFORMS;

  • You understand the Prize competition is free to enter;

  • You understand The Prize Competition is skill based and the terms of the skill based entry will be determined and published on Apple and/or Meta and/or Google and/or our website;

  • You understand Apple, Meta, TikTok and Google are in no way associated with the competition or the terms of the skill based entry of the competition or the amount or delivery of prizes;

  • You understand we may ask or encourage ratings or reviews on Apple and Google be we will in no way force or incentivise ratings or reviews at any time as per Apple and Google Developer Guidelines;

  • You understand we may encourage tags and shares, as per Meta and TikTok guidelines but we will never force tags or shares for competition entry;

  • You understand to qualify for PRIZES, you must finish first in the allowed time frame for Kenny's Custom, Rika's Special, Little Lucky's Unique, Crash Girls' Tournaments.

  • You understand the monetary value of the prizes will increase with the number of players and the number of shared links at our discretion;

  • You understand to be eligible to receive Prizes you are required to enter a correct email address. This is our primary method of verifying your entry;

  • You understand if you are an employee or family member of an employee (defined as father, mother, brother, sister, child, spouse), or a business associate of Waffle Cone Pty Ltd, you are ineligible for Prizes;

  • You understand if you have been dishonest by cheating, you will be ineligible for Prizes;

  • You understand you may be asked to show proof of progression within the application via digital media, such as screenshot;

  • You understand we may request you to provide us with media endorsing the Application and/or if you are a winner of Prizes;

  • You understand we have the Intellectual Property rights to your digital media and that we may use your media in future promotions or marketing efforts;

  • You understand you will be notified within 30 days via email if you win the competition and the Prizes and all applicants will be judged fairly based on definitions of “skill”, meaning, the most deserving winner as decided by a judge;

  • You understand “Sharing” is optional to increase cash prizes, as per Meta, TikTok guidelines;

  • You understand for "Character and Vehicle" Competition Prize, revenue is calculated at 25% after fees and is paid in 3x4 instalments up to the combined value of USD $1 million. 

  • You understand that in usual cases, you will be issued with Prizes or Prizes begin within 30 business days. We reserve the right due to irregular circumstances, to take up to 90 days to pay or begin Prizes, although this is not usual;

  • You understand we are not responsible for any fees, taxes or bank charges associated with the receiving of Prizes;

  • You understand we may require you to validate your personal location;

  • You understand each PRIZE competition will have a published start and end date, condition of entry,  and links to the website for these Terms, Privacy Policy and Terms and Conditions can be found on Apple and/or Meta and/or TikTok and/or Google;

  • You understand that all prize winners will be displayed on our official website or official Meta accounts or official TikTok accounts and/or within the Application;

  • You understand if 2 or more players have an equal fastest time or top score to qualify to enter PRIZE competition, all players with winning score will be eligible to enter for PRIZES;

 

 

**1.2 Changes to the Terms -** We reserve the right to amend or replace any part of these Terms, as well as the Privacy Policy, and Terms and Conditions, without prior notice. You agree that We may notify You of any updated or new Terms by posting on our website and within the Application and that Your continued use of the Services following the posting of revised Terms shall constitute Your agreement with those changes. We also reserve the right to modify or discontinue, temporarily or permanently, the Services (or any part thereof) with or without notice. You agree that We will not be liable to You or to any third party for any modification, suspension, or discontinuance of the Services.

 

2. DEFINITIONS

 

**2.1 “Prizes” is defined by any product or service provided for free, including or excluding personal characters in game, personal vehicles in game, discount coupons for in game currency, gift cards from partners/affiliates, free subscriptions to the app;

 

 

**2.2 Eligible Jurisdictions -** You acknowledge that various rules, regulations, and laws addressing skill based free to enter competitions and tournaments with prizes may govern Your participation in competitions and that such laws are set up by each individual state, country, territory, or jurisdiction.

 

You are not eligible for cash prizes in any other jurisdiction and in particular in a jurisdiction in which it is illegal for You to do so. However, in any other jurisdiction, free use of the game according to Terms and Services and Privacy Policy is allowed.

 

It is Your responsibility to determine whether the State, country, territory, or jurisdiction where You are located is an Eligible Jurisdiction.

 

**2.3 Personal location -** We reserve the right (but has no obligation) to provide proof of location through a passport, driver’s license or government ID. In the case where You win a Cash Prize from a location outside the Eligible Jurisdictions, We may refuse delivery of prize.

 

 

**2.4 Start and end date are classified as the start of the competition as outlined in the competition published on Apple and/or Meta and/or Google and/or TikTok and/or website. Any Player who is in an active Round after the end of the competition is ineligible for the next Tournament with said attempt. The next Tournament must be accessed after the start time as outlined on Apple. 

 

 

**2.5 Cheating is classified as any tampering with the Application, including but not restricted to hacking, using bots, manipulating data or media, using media that you do not own;

 

**2.6 “Refer Friends” is classified as the act of tagging set number of friends in comments of relevant Meta posts or Reels on our official Instagram or Facebook account. Tagging of photos will not be accepted, as per Meta guidelines.
